City Commission Mtg. 7-Jan-4 Recap

 Summary:




Item 7…Presentation of an update report on Street Projects in progress.

There was not much to report due to the weather and holidays. No work will be done on Franklin Street; instead the city crew will work on Elba (?) Street. Mayor Pro Tem Tony Gonzalez requested the city crew to look at Juanita Street.

Ms. Marie C. Leal, Consulting Engineer from Brown, Leal & Associates, updated the commission on the progress for the top 4 streets on the Street Project. Bid Requests to be published on the newspaper on January 19 and 26. Bids are to be received by Feb. 6. If everything goes according to plan contractor street work to begin In March or April depending on the weather.


Agenda items 8, 9 , 10, and 11 all relate to an agreement between the City and the Texas Dept. of Transportation (TXDOT). It relates to the mowing of the grass on the frontage road of Hwy. 77. TXDOT only mows the grass ONLY twice a year. When it rains and the grass grows and grows, this becomes a problem for the city. With this agreement the City can now obtain permits from the TXDOT to mow the grass.

TXDOT is trying to passthru the mowing responsibilities to cities with populations of 50,000 or more residents. Since the City of San Benito is less than 50,000 residents it must request permits to mow the grass on the frontage road.

All four agenda items were approved with “one” motion. However, this is not legal. Each agenda item posted and published individually for “consideration and action” must be voted on individually. I did inform the Mayor and the Commission via Email regarding the illegal motion so we will see.


8. Consideration and action on approval of the Maintenance Agreement between Texas Department of Transportation and the City of San Benito.

9. Consideration and action on second reading of Ordinance No. 2509: An Ordinance providing for maintenance of certain Highways and/or portions of State Highways in the City of San Benito.

10. Consideration and action on second reading of Ordinance No. 2510: An Ordinance approving the agreement dated December 17, 2013 between the State of Texas and the City of San Benito.

11. Consideration and action on approval of Resolution 2013-18: A resolution approving Maintenance and Agreement between the State of Texas and Department of Transportation and the City of San Benito.
